1. Eligibility

VAYAM is intended for individuals aged 18 years or older.

• You are at least 18 years old.
• You are a parent, guardian, caregiver, educator, therapist, healthcare professional, or otherwise authorized to use the Platform.
• Information you provide is accurate and current.
• • You are responsible for maintaining the confidentiality of your account credentials.

2. Purpose of the Platform

VAYAM is a community platform designed to connect parents, caregivers, educators, therapists, healthcare professionals, and organizations supporting children and individuals with developmental needs. The Platform enables users to:

• Connect with parents and caregivers.
• Join communities and discussions.
• Discover therapists, doctors and institutes.
• Buy and sell through the Marketplace.
• Access educational resources.
• Participate in events and support groups.

VAYAM is NOT a medical institution, hospital, therapy provider, or emergency service.

3. Medical Disclaimer

Information shared on VAYAM - including community discussions, articles, AI-generated content (where applicable), professional profiles, and recommendations - is for educational and informational purposes only.

It should never be considered a substitute for:

• Medical diagnosis
• Psychological evaluation
• Therapy
• Professional treatment
• Emergency medical care

4. AI-Generated Content

AI may generate summaries, recommendations and educational insights.

• May be inaccurate or incomplete.
• Is not professional medical advice.
• Is generated from user inputs and general knowledge.

Users remain solely responsible for decisions made based on AI-generated information.

5a. Professional Verification & Disclaimer

VAYAM may verify the identity, qualifications, registrations, or credentials of professionals, educators, therapists, institutions, schools, clinics, and organizations based on the documents and information they provide during onboarding.

Such verification only indicates that VAYAM has made reasonable efforts to validate the submitted information at the time of onboarding. It does not:

Guarantee the quality, accuracy, or standard of services provided.
Guarantee the effectiveness of any treatment, therapy, educational program, or outcome.
Create any employment, partnership, agency, or contractual relationship between VAYAM and the professional or organization.
Constitute an endorsement, recommendation, certification, or warranty by VAYAM.

Users are encouraged to independently evaluate and verify any professional, institution, or service provider before engaging their services.

5b. Responsibilities of Professionals

Professionals, educators, therapists, institutions, and organizations using VAYAM are solely responsible for ensuring compliance with all applicable laws, regulations, professional standards, and ethical obligations, including but not limited to:

• Maintaining valid licenses, registrations, certifications, or accreditations, where applicable.
• Adhering to applicable professional codes of ethics and conduct.
• Protecting the confidentiality and privacy of client or patient information.
• Complying with all applicable local, state, national, and regulatory requirements governing their profession or services.

VAYAM acts solely as a technology platform that facilitates discovery and connection between users and professionals. VAYAM does not provide, supervise, manage, or guarantee the professional services offered through the platform and is not responsible for the actions, advice, treatment, or conduct of any professional, institution, or organization listed on the platform. Any engagement or agreement between a user and a professional is entered into directly between those parties, and VAYAM is not a party to such arrangements.

6. Marketplace

The VAYAM Marketplace enables users to buy, sell, donate, exchange, or give away products directly with one another. All Marketplace transactions are conducted solely between the buyer and the seller.

VAYAM acts only as a technology platform that facilitates these connections and is not a party to any transaction.

Accordingly, VAYAM:

• Does not own, manufacture, store, or sell any products listed on the Marketplace.
• Does not inspect, verify, or certify the condition, authenticity, legality, or safety of listed items.
• Does not guarantee the quality, accuracy, availability, suitability, pricing, delivery, or condition of any product.
• Does not process payments, act as an escrow service, or guarantee refunds.
• Is not responsible for disputes, losses, damages, delays, misrepresentations, non-delivery, or any other issues arising between buyers and sellers.

Users are solely responsible for ensuring that all Marketplace listings comply with applicable laws and accurately describe the products being offered.

Prohibited Items

The following items must not be listed, sold, donated, exchanged, or advertised through the VAYAM Marketplace:

• Prescription medicines or medical devices requiring regulatory approval.
• Controlled substances, narcotics, or illegal drugs.
• Weapons, firearms, ammunition, explosives, or hazardous materials.
• Illegal, stolen, or prohibited goods.
• Counterfeit, pirated, or infringing products.
• Live animals or wildlife.
• Alcohol, tobacco, nicotine products, or vaping devices.
• Products that violate any applicable law or regulation.
• Any item that VAYAM, at its sole discretion, considers unsafe, inappropriate, or inconsistent with the purpose of the platform.

VAYAM reserves the right to remove any listing, suspend Marketplace access, or terminate user accounts that violate these terms or applicable laws, without prior notice.

7. User Content

You retain ownership of your posts, comments, photos, videos, documents, messages and listings. By submitting content, you grant VAYAM a worldwide, non-exclusive, royalty-free license to:

• Store
• Display
• Process
• Moderate
• Reproduce
• Improve the Platform

solely for operating, maintaining, securing, and promoting VAYAM.

We do not claim ownership of your content.

8. Parent Responsibility, Privacy and Child Information

8a. Your Child's Information

Parents and legal guardians remain in full control of the information they choose to share about their child on VAYAM.

This may include, but is not limited to:

• Mobile numbers and contact details
• Home or mailing addresses
• Medical records and reports
• Child photographs
• Therapy notes and reports
• Videos and other uploaded documents

We encourage users to share personal or sensitive information only when necessary and to avoid posting personally identifiable information in public areas of the platform, such as community posts or comments.

VAYAM does not sell, rent, or trade your personal information or your child's information to third parties.

8b. Parental Responsibility

VAYAM is designed to provide information, resources, community support, and connections to professionals. However, all decisions relating to a child's care remain the sole responsibility of the parent or legal guardian.

This includes decisions regarding:

• Healthcare and medical treatment
• Medication
• Therapy and rehabilitation
• Education and learning plans
• Safety and overall well-being

Any information, recommendations, AI-generated insights, or community discussions available on VAYAM should be used as a supportive resource and must not replace the advice, diagnosis, or treatment provided by qualified professionals. Parents and guardians should exercise their own judgment and consult appropriate professionals before making decisions concerning their child's health, development, education, or care.

9. Acceptable Use

Users agree not to:

• Post abusive, hateful or threatening content.
• Upload pornography or nudity.
• Harass or bully others.
• Share illegal content.
• Spread harmful misinformation.
• Impersonate another person.
• Attempt unauthorized access.
• Upload malware.
• Use automated bots without permission.
• Spam or advertise unrelated products.

Violation of these Terms may result in suspension or permanent removal.

10. Community Guidelines

Please treat every member of the VAYAM community with kindness, empathy, and respect. Healthy discussions and differing opinions are welcome, but they must always be expressed in a respectful and constructive manner.

Any behavior that is abusive, harassing, discriminatory, threatening, or otherwise violates our Community Guidelines may result in the removal of content, temporary suspension, or permanent termination of your account.

11. Account Suspension and Termination

VAYAM may suspend or terminate accounts that:

• Violate these Terms.
• Violate Community Guidelines.
• Break applicable laws.
• Attempt fraud or abuse.
• Compromise platform security.

12. Service Availability & No Warranty

The Platform is provided "as is" & "as available." We strive for reliable service but do not guarantee uninterrupted availability, accuracy, completeness or suitability for any particular purpose. Features may change, improve or be retired as the platform evolves. Maintenance, upgrades, or unforeseen technical issues may temporarily affect availability.

13. Intellectual Property

The VAYAM name, logo, branding, graphics and software are the intellectual property of Rudraaksh Quantum Labs Private Limited. Users may not copy, reproduce, modify, distribute, or commercially exploit Platform content without prior written permission.

14. Limitation of Liability

To the maximum extent permitted by law, VAYAM is not liable for medical decisions, community advice, professional consultations, marketplace transactions, data loss, service interruptions, indirect damages or loss of profits or business opportunities. Total liability is limited to the amount paid by you during the previous 12 months.

15. Indemnity

You agree to indemnify and hold harmless Rudraaksh Quantum Labs Private Limited, its directors, employees, affiliates, and partners against claims arising from your use of the Platform, violation of these Terms, applicable laws or third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. If significant changes are made, we will notify users through the Platform or via email where appropriate. Continued use of the Platform after the revised Terms become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
